Habitatges d’ús turístic (HUT) need a register number on every listing; new apartment and studio HUT authorisations are suspended indefinitely under Llei 5/2025. Separately, Llei 19/2022 IEAT charges €1–€3 per person per night by category. Andorra is not an EU Member State and not in Schengen.

What hosts and hotels actually need to know

Andorran short-stay compliance is denser than a soft platform habit and different from Spanish SES.HOSPEDAJES or French police fiches. First, guest registration: Llei 16/2017 arts. 48–49 oblige tourist lodgings (hotels, apartments, HUT and most other groups) to keep an occupation register, collect identity for clients aged 16+, and transmit personal data electronically to the Police; the ROAT Reglament sets a 12-hour send clock (before departure if the stay is under 24 hours) and daily updates. Second, licensing: classified hotels and other modalities need commerce / tourism footing and a plaque or certificate; HUT must be inscribed in the ministry HUT register with the number on every advertisement — and Llei 5/2025 suspends new apartment and studio HUT authorisations and register altes. Third, IEAT: hosts collect and remit the overnight tax (€3 for 5★, €2 for 4★ / HUT, €1.50 for 2–3★, €1 for the rest), with Andorran residents, under-16s and nights beyond seven in the same establishment exempt. Fourth, Andorra sits in a customs union with the EU for industrial goods but remains outside the EU and Schengen — guest identity data is processed under Llei 29/2021 (LQPD), not GDPR or Regulation (EU) 2024/1028. Self check-in works when identity capture, ROAT fields and access release are sequenced before the key unlocks.

Guest registration — ROAT under Llei 16/2017

Every tourist lodging (with narrow refuge / motorhome exceptions) must keep an occupation register and transmit guest data to the Servei de Policia through ROAT.

    Who must register guests

    Llei 16/2017 art. 48 obliges tourist accommodations (except mountain refuges / bordes, motorhome reception areas and atypical lodgings with lighter rules) to keep an occupation register and send personal data electronically to the Servei de Policia. The ROAT Reglament art. 2 restates that tourist lodgings must register every client who stays. Govern materials note the duty has applied since 12 April 2013 and that alta follows classification (or HUT register footing).

    Identity for guests aged 16+

    Art. 49.1 requires every client except minors under 16 to present an identity document to the person registering clients in ROAT. Refusal must be notified to the Police within a maximum of 24 hours or before the guest leaves (art. 49.2; ROAT Reglament art. 8 points notifications to policia@policia.ad / 872 000). Police may check ROAT reliability at any time without notice.

    Fields, 12-hour clock and daily update

    ROAT Reglament art. 3 requires, for standard lodgings, arrival and departure dates plus — for guests 16+ — name, surnames, nationality, date and place of birth, and country of residence (minors: name, surnames, nationality, date of birth). HUT must also record the HUT register number. Art. 6: update ROAT daily; transmit to Police as soon as possible and before 12 hours from arrival; if the planned stay is under 24 hours, transmit before the guest leaves. Web app, web service (API) or flat-file bulk upload are the allowed channels (art. 4).

    ID copy retention

    Art. 49.5 and ROAT Reglament art. 15 require keeping a photocopy (paper or digital, with photograph) of the identity document for every guest 16+ for one year from inscription — unless that information was already transmitted through the ROAT programme, in which case the retention duty for the copy is lifted.

Tourism licence, HUT register & the apartment suspension

You cannot lawfully market tourist lodging in Andorra without the correct modality footing — classified establishment or inscribed HUT — and new apartment / studio HUT altes are suspended.

    Classified tourist establishments

    Llei 16/2017 organises lodging by modality (hotels, aparthotels, hostals, pensions, rural houses, campsites, tourist apartments and others) and requires official classification plaques or certificates before advertising a star or espiga category. Commerce registration with the matching activity and subsequent ROAT alta are the operational gate after classification.

    HUT register number on every listing

    Habitatges d’ús turístic must be inscribed in the ministry Registre d’HUT (art. 40). The inscription number must appear on every advertising or promotional support — including intermediaries and platforms. Government FAQ materials treat omission as a greu infringement with fines up to €3,000. Star classification of HUT is voluntary and only available after the HUT number exists.

    New apartment / studio HUT suspended (Llei 5/2025)

    Llei 5/2025, del 6 de març, per al creixement sostenible i el dret a l’habitatge, adds disposició addicional tercera to Llei 16/2017: from its entry into force, granting of new HUT authorisations for apartments and studios (art. 35) is suspended, and so is inscription of new altes in the HUT register for those types (art. 40). The ministry HUT pages publish that suspension as indefinite. Existing inscribed HUT continue under ROAT and IEAT duties; do not invent a new apartment listing without checking whether your unit already holds a number.

    EGHUT managers vs owners

    Empreses de gestió d’habitatges d’ús turístic (EGHUT) must register in the EGHUT register after commerce inscription. For IEAT, Govern tax guidance is explicit: the HUT owner files the censal declaration whether or not an EGHUT manages the unit. ROAT alta for direct HUT management still needs the HUT number and MIL / electronic identification.

Tourist tax — Impost sobre les estades (IEAT)

From 1 July 2022, Llei 19/2022 charges an overnight stay tax on tourist accommodations. Hosts collect it, file a censal alta, and settle quarterly against ROAT-fed proposals.

    Rates by category

    Art. 10 tariffs (euros per person per day or fraction): 5-star tourist lodgings €3.00; 4-star / 4-espiga lodgings €2.00; habitatges d’ús turístic €2.00; 2- or 3-star / espiga (or in classification process) €1.50; remaining tourist lodgings €1.00. The tax accrues at the start of the stay. Government tourism pages require ROAT alta first, then the Tributs i Fronteres censal declaration for platform access.

    Exemptions and the seven-night cap

    Seu Electrònica IEAT guidance lists full exemptions for: Andorran residents; minors under 16; nights beyond seven consecutive days in the same tourist lodging; stays ordered by Government social services; force majeure stays approved by Government; and certain colony houses / hostels organised or promoted by Andorran public entities. Motorhome reception areas are outside the taxable event.

    Quarterly liquidation calendar

    Between days 1–14 of April, July, October and January, Tributs i Fronteres issues a proposed liquidation from ROAT and the tourist-lodging census for the prior natural quarter. Substitutes of the taxpayer (the lodging operator) must present and subscribe the declaration between day 15 and the last day of those same months via the Seu electrònica. New operators file register alta (model 001R) before starting activity or within ten days of becoming titular.

    IEAT and IGI

    Where the substitute is an empresari for Impost General Indirecte (IGI) purposes, IEAT forms part of the IGI tax base under Llei de l’IGI art. 47.2.b as explained on the official IEAT FAQ — price the overnight tax into guest invoices with that interaction in mind.

Not EU, not Schengen — domestic Llei 29/2021 (LQPD)

Andorra is a sovereign Principality outside the EU and Schengen. Customs-union nuances with the EU do not import GDPR or Regulation (EU) 2024/1028 as Andorran lodging law — guest data sits under the LQPD.

    Not EU Member State — not Schengen

    Visitandorra’s official visitor guidance states Andorra is neither an EU member nor part of the Schengen area, while transit arrangements with Spain and France cover practical entry for most European travellers. AndorraUE’s disinformation page on the association agreement restates that Andorra will not become an EU Member State and will remain outside Schengen; the association text incorporates the existing customs-union agreement without converting Andorra into an EU lodging-law jurisdiction.

    Customs union — goods, not STR portals

    Govern Duana materials describe the 1990/1991 EU–Andorra customs union: free circulation and common tariff for industrial goods, with agricultural products (Harmonised System chapters 1–24) outside that union. That framing matters for shopping allowances and freight — it does not create an EU short-term rental registration number, DAC7 host duty as EU law, or a Schengen lodging fiche under Convention art. 45 as Andorran statute.

    Llei 29/2021 (LQPD) — domestic personal-data law

    Guest names, birth data, nationality, residence country, document copies and access logs are personal data when processed for ROAT and operations. Controllers established in Andorra (or using means in Andorra) process under Llei 29/2021, supervised by the Agència Andorrana de Protecció de Dades (APDA). Collect what the lodging / Police / IEAT legal basis requires, inform guests, secure storage, and respect subject rights. Older ROAT text still cites Llei 15/2003 — that statute has been replaced by the LQPD for current processing.

    GDPR and Reg 2024/1028 are not Andorran law

    Do not design Andorran check-in as if GDPR (Regulation (EU) 2016/679) or the short-term rental data Regulation (EU) 2024/1028 were domestic statutes. Alignment language in the LQPD exposició de motius does not rewrite ROAT clocks, HUT suspension rules or IEAT tariffs. If an EU platform imposes its own compliance fields, treat those as contractual platform rules — parallel to, not a substitute for, ROAT, HUT and IEAT.

Remote mountain arrival is common. Unverified arrival is the risk. Llei 16/2017 requires identity presentation to the provider’s registrar — it does not require a paper ledger at a lobby desk.

  • Verification is the check-in

    Treat document capture and ROAT field completion for every guest 16+ as the legal check-in moment. Door codes, lockboxes and smart locks should wait until those fields exist and can be transmitted within the 12-hour clock.

  • 12 hours still apply after a late ski transfer

    ROAT Reglament art. 6 does not pause for night arrivals or Pas de la Casa border queues. If the stay will be under 24 hours, transmit before the guest leaves — design pre-arrival collection so the host is not racing the departure.

  • Hotels and HUT share the same ROAT duty

    A five-star lobby and an Escaldes keybox apartment both need adult (16+) identity on file and timely Police transmission. Process design differs; the statutory outcome does not.

  • Refusal rights cut both ways

    If a guest 16+ will not present an identity document, notify the Police within 24 hours or before departure. Build that into house rules and guest messaging before arrival day — do not silently skip ROAT.

Parish, tax & border layers

ROAT and IEAT are national. Parishes still shape arrival logistics, and the French / Spanish borders shape how guests reach you.
