Poland's short-stay weight is municipal ewidencja — not a nationwide hotel guest-book.

Unlike Portugal's boletim or Austria's Gästeverzeichnis, Poland no longer runs a statutory hotelowe księgi meldunkowe duty for ordinary tourist nights. What hosts must get right is registering the unit as usługi hotelarskie in the municipal ewidencja before advertising, collecting opłata miejscowa only where the gmina levies it, and treating guest identity capture as contract, safety and GDPR practice — especially for self check-in.

What hosts and hotels actually need to know

Poland's STR framework is lighter on guest-identity reporting than many Mediterranean and Central European peers — and that is the point of this guide. The Ustawa z dnia 24 września 2010 r. o ewidencji ludności still sets a municipal obowiązek meldunkowy for people who take up pobyt stały or czasowy, but that track is not a per-night hotel registration book for short tourist stays (Polish temporary residence for this purpose is framed around stays lasting more than three months). The operative tourism statute is the Ustawa z dnia 29 sierpnia 1997 r. o usługach hotelarskich oraz usługach pilotów wycieczek i przewodników turystycznych (t.j. Dz.U. 2023 poz. 1944): short-term, publicly available letting of flats and rooms is a usługa hotelarska, and non-categorised units must be entered in the ewidencja run by the wójt / burmistrz / prezydent miasta before services start (arts. 35, 38–39). Opłata miejscowa under the Ustawa z dnia 12 stycznia 1991 r. o podatkach i opłatach lokalnych is optional for each gmina and capped nationally (3,46 zł / day in ordinary localities for 2026). Warsaw and Kraków do not currently levy it; Gdańsk does. A national CWTON / STR registration act implementing Regulation (EU) 2024/1028 was still described as a Ministry of Sport and Tourism project in April 2026 — municipal ewidencje (and Gdańsk's identification numbers) are what hosts can act on today.

Categorised obiekty hotelarskie (hotel, motel, pensjonat, etc.) go through marszałek województwa classification; guest-facing identity capture is operational and GDPR-led, not a revived meldunek book.

No nationwide hotel guest-book — what remains

Poland repealed the old hotelowe księgi meldunkowe formalities when population-registration rules were modernised. Short tourist nights are not automatically a PESEL / gmina meldunek event.

    Municipal meldunek is not a per-night hotel form

    The Ustawa o ewidencji ludności still requires Polish nationals and foreigners who live in Poland to complete zameldowanie on pobyt stały or czasowy through the gmina (gov.pl). For Polish citizens, pobyt czasowy in that statute is framed as presence outside the permanent address for more than three months. Ordinary multi-night tourist stays in a hotel or apartment are not, on that basis, a revived hotelowe księgi meldunkowe duty to the PESEL register.

    Do not invent Border Guard / police STR forms

    This dossier does not assert a standing nationwide duty for every STR host to file a 24-hour police or Straż Graniczna guest sheet for each tourist. Where a specific primary source for a property category requires otherwise, follow that source — do not copy Mediterranean or Austrian guest-book workflows onto Poland by analogy.

    Still capture identity for the stay

    Even without a national guest-book statute, hosts need guest identity and stay dates for the accommodation contract, building access control, neighbour complaints, and any municipal tax inkaso. Digital pre-arrival capture is consistent with that operational need and with GDPR art. 5 minimisation — collect what the legal basis and the stay require, not a photocopy archive of passports.

Municipal ewidencja of usług hotelarskich

Arts. 35 and 38–39 of the hotel-services statute split classified obiekty hotelarskie (marszałek) from other objects (gmina ewidencja). Apartment STR almost always sits on the second track.

    Register before you advertise

    Before starting usługi hotelarskie in a non-categorised object (apartment, guest rooms, hostel-style stock, etc.), the entrepreneur or farmer must notify the ewidencja kept by the wójt, burmistrz or prezydent miasta for the property's location (art. 39). Biznes.gov.pl, ePUAP and city portals (Warsaw districts, Kraków, Gdańsk) spell out the same sequence: file first, then operate. Operating without registration can engage Kodeks wykroczeń sanctions highlighted on official city pages.

  2. 02

    Sanitary, fire and equipment minimums

    Art. 35 and the rozporządzenie on hotel and other lodging objects (t.j. Dz.U. 2017 poz. 2166) set sanitary, fire-safety and minimum equipment expectations. From March 2020, art. 35 ust. 4 adds a presumption that objects providing hotel services without prior ewidencja notification do not meet the sanitary requirements — Kraków's lodging guide emphasises attaching a sanitary opinion when filing.

  3. 03

    Classified hotels are a parallel track

    Hotels, motels, pensjonaty and other named rodzaje obtain zaszeregowanie and category from the marszałek województwa (art. 38 ust. 1). Do not file those units into the gmina's "other objects" list as a substitute for classification — and do not use protected type names for unregistered apartments.

  4. 04

    CEIDG when the activity is a business

    Municipal ewidencja filings ask for NIP and CEIDG or KRS numbers where the operator holds them. Organised, continuous, for-profit short-term letting typically engages Prawo przedsiębiorców and CEIDG registration via biznes.gov.pl — distinct from the lodging-object ewidencja itself. Occasional private residential letting can sit differently for tax purposes; treat classification as facts-and-circumstances and confirm with a tax advisor when scale or services look commercial.

Opłata miejscowa — municipal, not automatic

Under the local taxes act, a gmina may levy opłata miejscowa on natural persons staying more than a day for tourism, leisure or training — only in localities that meet statutory climate / landscape (or spa-protection) criteria, and only up to the national ceiling.

    National ceiling for 2026

    The Minister of Finance and Economy's obwieszczenie of 1 August 2025 (M.P. 2025 poz. 726) sets the 2026 upper limit for ordinary opłata miejscowa at 3,46 zł per day (4,89 zł in spa-protection areas). A gmina rada must still pass an uchwała to levy any rate — the ceiling is not a nationwide tourist tax.

    Warsaw and Kraków — no current opłata miejscowa

    Warsaw's BIP local-tax pages list property, agricultural, forest and vehicle taxes and stamp duty — not an active tourist opłata miejscowa. Kraków's official communications document multi-year lobbying for a broader opłata turystyczna because the climate-criteria gate in the local-taxes act blocks most large cities from using today's opłata miejscowa. Do not invent Warsaw or Kraków per-night tourist-tax rates.

    Gdańsk — 3,46 zł and inkaso

    Gdańsk levies opłata miejscowa. The city's lodging-registration procedure and BIP state the 2026 rate as 3,46 zł for each started day of stay by natural persons present more than a day for tourism, leisure or training, under Uchwała Rady Miasta Gdańska Nr XX/438/25 of 30 October 2025. Operators of short-term lodging become inkasenci and remit on the city's published schedule.

EU law that sits underneath

Poland's lighter guest-book posture still sits inside Schengen lodging purposes, GDPR, and the 2024 short-term rental data framework — with national implementation still catching up as of mid-2026.

    Schengen Convention — Article 45(1)(b)

    Lodging providers across Schengen states are expected to account for who stayed where. Poland currently leans on municipal facility registration and operational guest records rather than a Portugal-style national boletim channel — that does not erase the underlying public-security purpose.

    GDPR (Regulation (EU) 2016/679)

    Guest identity, document numbers and signatures are personal data. Collect what the contract, safety and any statutory tax inkaso require; inform guests; secure storage; delete or anonymise when the purpose ends.

    Short-term rental data — Regulation (EU) 2024/1028

    From 20 May 2026 the EU framework expects registration numbers and platform activity reporting where Member States operate STR registration systems. Poland's Ministry of Sport and Tourism described a national CWTON / municipal-registration bill as a project in April 2026. Gdańsk already ties its ewidencja identification numbers to that EU date on official pages — watch Sejm enactment rather than assuming a finished central portal.

Remote arrival · Still the law

Self check-in under Polish rules

Remote arrival is routine in Polish city apartments. Because there is no nationwide signed guest-book statute, the practical gate is capturing the identity and stay data you need for the contract, access control and any local tax — before keys release — and keeping the unit on the municipal ewidencja.

    Build guest name, contact, document reference and stay dates into the check-in flow itself. Release door codes or lockbox instructions only after that data is complete — the operational equivalent of a front-desk registration card, without inventing a PESEL meldunek.

    A polished self check-in flow does not replace art. 39 notification to the gmina. Confirm the Warsaw district, Kraków or Gdańsk ewidencja entry (and any identification number the city issues) before scaling remote arrivals.

    In Gdańsk, treat tax collection as part of arrival messaging. In Warsaw and Kraków, do not add a fictional tourist-tax line item — confirm any future uchwała before quoting guests.

  • Longer stays may trigger real meldunek

    If a guest's presence crosses into pobyt czasowy thresholds under the population-registration statute (more than three months for the Polish temporary-stay concept), the guest's own municipal zameldowanie duties can appear — that is still the guest/gmina track, not a hotel guest-book revival.

National hotel-services rules are shared. Cities differ on how ewidencja is filed and whether opłata miejscowa exists at all.

    Prezydent m.st. Warszawy runs the ewidencja of other lodging objects via district offices (ePUAP / mobywatel filings accepted). Filing is free. Warsaw BIP local-tax materials do not publish an active opłata miejscowa for tourist nights — collect guest data for operations, not for a city tourist tax that is not in force.

    Prezydent Miasta Krakowa keeps the ewidencja of non-categorised lodging objects (art. 38 ust. 3); the city's lodging informator and ekon.um.krakow.pl list point hosts to Wydział ds. Turystyki filings, typically with a sanitary opinion. Kraków has publicly pressed for statutory room to introduce an opłata turystyczna — it is not currently collecting opłata miejscowa as a general city tourist tax under the climate-criteria gate.

Separately, 2026 opłata miejscowa is 3,46 zł per started day for qualifying stays; hosts act as inkasenci per BIP and Uchwała XX/438/25.
