What hotels and hosts actually need to know

Spain’s public-security lodging rules live in Real Decreto 933/2021 and run through the Ministry of the Interior’s SES.HOSPEDAJES platform. Autonomous communities still licence tourist dwellings (HUT in Catalonia, VUT in Madrid and Valencia, VFT/VUT in Andalusia). Catalonia’s IEET tourist tax — with Barcelona’s municipal surcharge — is a separate money track; Valencia city has no overnight tourist tax as of this review. Self check-in remains workable when guest data is complete before access is released — Interior FAQ text expressly allows remote verification — and when SES communications stay on the dual 24-hour clock.

Guest data under RD 933/2021

Lodging providers must collect the documentary data listed in the decree’s annexes from users of the accommodation — then register and communicate it to the competent authorities.

    Who is in scope

    Natural or legal persons that carry out lodging activities in Spain — professionally or not — and intermediaries. Ministry FAQ materials state the regime covers hotels, hostels, tourist apartments, rural stays, campsites and similar lodging offered for a price, regardless of stay length, when the purpose is not permanent housing.

    What to collect

    Annex I sets out traveller and stay fields (identity document type and number, names, date of birth, nationality, check-in/out, and related reservation and payment identifiers). Incomplete guest data is a common cause of SES rejections — design forms against the annex, not a marketing preference. Valid ID types in Interior FAQ guidance: DNI (Spanish adults 14+), EU identity document, passport for other foreign nationals.

    Remote collection is expressly allowed

    Interior FAQ text states establishments may gather information by any system that lets them verify data accuracy — including without physical presence — provided data-protection rules are met. That is the statutory footing for structured online check-in before keys release.

    Professionals vs non-professionals

    Professionals (those in the tax census of entrepreneurs / professionals) must keep a computerised register of Annex data for three years after the end of the contracted service. Non-professionals remain under the communication duties of art. 6; Ministry FAQ text excepts them from the full documentary register/conservation block while still requiring communications. Art. 6.4 also allows non-professionals non-telematic filing if the Ministry so determines — SES remains the default practical channel.

SES.HOSPEDAJES & the dual 24-hour clock

SES.HOSPEDAJES is the Ministry of the Interior’s electronic channel for lodging communications. Two clocks matter: reservation (or cancellation), then start of stay.

    Register the establishment first

    Before transmitting stays, obligated parties register on the Interior electronic headquarters Hospedajes / SES.HOSPEDAJES flow (Cl@ve or digital certificate) to obtain the codes and credentials needed to communicate. Establishment registration must occur within ten days of completing any required administrative steps and in any case before effective operation (art. 6.1–6.2).

  2. 02

    Reservation communication

    When a reservation or contract is made — or cancelled — transmit the required data immediately and in any case within 24 hours. Do not wait for arrival day to report a booking that already exists. Material changes to reservation data trigger a new communication.

  3. 03

    Check-in communication

    When contracted services start (check-in), transmit the guest / stay communication within 24 hours. This is a separate step from the reservation message.

  4. 04

    Intermediaries do not replace you

    Ministry FAQ text states that when an intermediary is involved, each obligated party must transmit the information it holds; where several intermediaries sit in the chain, the party with the direct contractual relationship with the guest communicates. An OTA booking confirmation is not a substitute for the host’s SES duties.

    Sanctions posture

    Under RD 933/2021 and Ley Orgánica 4/2015, late or incomplete communications / register irregularities are typically minor offences (€100–€600 per Interior FAQ). Failure to appear as a lodging provider or to communicate guest data is treated as serious (€601–€30,000). Treat SES as a public-security duty, not a soft tourism formality.

Regional licences — four different maps

Interior reporting is national. Permission to operate a tourist dwelling is regional — Catalonia, Madrid, Andalusia and Valencia each use different labels, portals and urban filters. The 2024–2026 national registration decree has been partially struck down.

    Catalonia — HUT + Registro de Turisme

    Habitatges d’ús turístic (HUT) are whole dwellings ceded for continuous stays of 31 days or less for a price. The owner communicates tourist use to the municipality; the Generalitat then inscribes the dwelling in the Registre de Turisme de Catalunya (RTC / NIRTC). In municipalities listed under Decreto-ley 3/2023, a prior urban licence (five-year, renewable) is required before tourist use — Barcelona is firmly in that tensioned-housing posture.

    Madrid — VUT + declaración responsable

    Comunidad de Madrid regulates viviendas de uso turístico under Decreto 79/2014 (as amended, including Decreto 27/2026). Activity starts with a declaración responsable to the Dirección General de Turismo y Hostelería, inscription in the regional tourism-enterprise register, a CIVUT suitability certificate, and a distinctive plaque. Community-of-owners statutes may prohibit the use; municipalities may set density limits by planning.

    Andalusia — VUT / VFT registration

    Junta de Andalucía treats viviendas de uso turístico as immediately usable dwellings offered for price on tourism channels on a habitual basis. Operators file a declaración responsable via the Junta’s digital window and receive a Registro de Turismo inscription code (e.g. VUT/MA/… or legacy VFT/… formats) that must appear on all publicity, including OTAs. Municipal urban rules and community authorisations still apply alongside the regional inscription.

    Valencia Community — VUT + five-year inscription

    Comunitat Valenciana registers viviendas de uso turístico through GVA Autoregistro (código GVA 19207) with a declaración responsable, unique cadastral reference, and a favourable municipal urban-compatibility report (CSV-verifiable). Inscription in the regional tourism register is valid for five years from presentation under current GVA guidance — renew before it lapses.

    RD 1312/2024 & the May 2026 Supreme Court ruling

    Real Decreto 1312/2024 created a national short-stay registration procedure and Ventanilla Única Digital aligned with EU Regulation 2024/1028. On 19 May 2026 the Tribunal Supremo partially annulled provisions on the unique registration procedure and the property-registry inscription route to obtain a registration number for platform listings. Do not treat NRU / VUD mechanics as settled national law without checking the current BOE / Housing Ministry position — regional tourism registers remain the operational licence track.

EU law that sits underneath

Spain’s Interior lodging communications sit inside the same European stack hosts meet elsewhere — Schengen lodging purposes, GDPR, and the 2024 short-term rental data framework.

    Schengen Convention — Article 45(1)(b)

    Lodging providers across Schengen states are expected to account for who stayed where. SES.HOSPEDAJES is Spain’s national electronic implementation of that public-security logic — Interior materials explicitly link the register to Schengen Article 45 and to Ley Orgánica 4/2015 art. 25.

    GDPR (Regulation (EU) 2016/679)

    Identity and document data are personal data. Collect what the legal basis requires, inform guests, secure transmission to SES, and respect retention limits on your own systems (professionals: three-year register under RD 933/2021). Processing for police purposes of the SES files themselves follows the Spanish criminal-data protection track cited in the decree.

    Short-term rental data — Regulation (EU) 2024/1028

    From 20 May 2026, where Member States operate STR registration/data systems, platforms work through harmonised registration numbers and activity reporting. Spain’s RD 1312/2024 attempted that alignment; after the May 2026 partial annulment, watch how Housing Ministry and regional systems re-implement the EU framework while continuing to rely on comunidad tourism registers.

Remote arrival is common in Spanish apartments. Unverified arrival is the risk. RD 933/2021 expects guest data you can communicate — Interior FAQ text expressly allows collection without physical presence when accuracy can be verified.

  • Data completion is the check-in moment

    Treat collection of Annex identity and stay fields for every reportable guest as the legal check-in gate. Door codes and lockboxes should wait until those records are complete enough to file.

  • Remote verification is on-policy

    Interior guidance allows any system that verifies data accuracy without requiring the guest to stand at a desk — including electronic identity checks — subject to transparency and data-protection duties. Build that verification into the pre-arrival flow, not a selfie dump without form fields.

  • Two clocks — not one

    Communicate the reservation when it exists. Communicate check-in when the stay starts. Mixing the two steps is a common operational failure.

  • Licence first — then access automation

    Regional tourist-dwelling authorisation (HUT / VUT / VFT where required) and SES establishment registration come before polished remote arrival. Automating keys for an unauthorised listing does not fix the underlying compliance gap.

Municipal, regional & tax layers

SES is national. Cities and regions still licence tourist dwellings and — where they levy it — collect tourist tax. Do not invent a Valencia overnight tax; confirm Catalonia IEET bands on the ATC tables.

    Catalonia’s Impost sobre les Estades en Establiments Turístics (IEET) is collected via the lodging provider and declared to Agència Tributària de Catalunya (models 950/940/920 on the published April/October windows). From 1 April 2026, ATC tariffs for Barcelona city list vivienda de uso turístico at €4.50 IEET + €5.00 Ajuntament surcharge = €9.50 per person per day or fraction (max seven units of stay). Other Catalonia municipalities use lower regional bands (€1.75 for HUT through 31 March 2027) and may add their own surcharge from October 2026 under Ley 2/2026. Always quote from the current ATC table for the establishment category.

    PEUAT (Plan especial urbanístico de alojamientos turísticos) sets zero growth for viviendas de uso turístico across the city. Decreto-ley 3/2023 places Barcelona among municipalities requiring prior urban licence for HUT use, with five-year licence windows. City materials describe a policy of not renewing existing HUT licences when they expire toward 2028. SES reporting does not create a tourism or urban licence — verify the property’s current RTC number and PEUAT status before listing.

  • Madrid city centre — regional VUT rules without a Barcelona-style city tax

    Madrid city relies on Comunidad VUT rules (declaración responsable, CIVUT, Registro de Empresas Turísticas) rather than a Barcelona-style overnight tourist tax. Málaga properties sit under Andalusia’s VUT/VFT Registro de Turismo inscription and local urban filters. Valencia city has debated a tasa turística but, as of this review, has not adopted an overnight stay tax in municipal fiscal ordinances — hosts still need the five-year GVA VUT inscription and municipal compatibility report. Confirm the comunidad and municipality that match the property address before automating pricing messages.

    Agencia Tributaria guidance: tourist-apartment lettings are generally rendimientos del capital inmobiliario when you only make the dwelling available (no hotel-like complementary services). If you provide hotel-industry services (periodic cleaning/laundry, catering, leisure) or have at least one full-time employee organising the activity, income is treated as actividad económica. Temporary tourist lettings do not qualify for the habitual-dwelling net-yield reductions. Platform/operator information duties sit on the DAC7 / modelo 238 track that replaced modelo 179 from February 2024 — parallel to, not a substitute for, SES or regional tourism registers.
